1. Acceptance of Terms

By accessing or using SpotWala ("the Platform"), you agree to be bound by these Terms of Service. SpotWala is operated by Smartshopz LLP, registered in Bangalore, India. If you do not agree with these terms, please do not use our services.

2. Services Description

SpotWala provides an online marketplace that connects people looking for parking spaces ("Renters") with people who have available spaces ("Hosts"). SpotWala acts as an intermediary and does not own or operate any parking facilities.

Our services include search and discovery, booking management, messaging, and customer support. SpotWala does not process payments — all payments are made directly between Renters and Hosts.

3. User Accounts

To use certain features of the Platform, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Not create multiple accounts for deceptive purposes

4. Bookings & Payments

When a Renter makes a booking, they agree to pay the listed price directly to the Host. SpotWala facilitates the connection between Renters and Hosts but does not process payments.

• SpotWala currently charges no platform fees or commissions
• Hosts keep 100% of the booking value
• Renters pay hosts directly via mutually agreed payment method
• Payment terms are agreed upon between Host and Renter

5. Cancellation Policy

Cancellation policies may vary by listing. Since payments are made directly between Renters and Hosts, refunds are handled between the parties. SpotWala will assist in mediation if needed. The default guideline is:

• Full refund if cancelled 2+ hours before check-in time
• 50% refund if cancelled within 2 hours of check-in
• No refund for no-shows or cancellation after check-in
• Monthly bookings: 7-day cancellation notice required for full refund

6. Host Responsibilities

Hosts agree to:

• Provide accurate descriptions and photos of their spaces
• Maintain their spaces in a safe and accessible condition
• Honor confirmed bookings
• Respond to messages within 24 hours
• Comply with all local regulations regarding space rental

7. Renter Responsibilities

Renters agree to:

• Use the space only for its intended purpose
• Vacate the space by the agreed check-out time
• Not store hazardous or illegal materials
• Report any damage or issues to the Host and SpotWala
• Treat the Host's property with respect

8. Limitation of Liability

SpotWala acts as a marketplace intermediary. We are not liable for any loss, damage, or theft that occurs at listed spaces. Hosts and Renters engage with each other at their own risk. SpotWala does not provide insurance coverage for vehicles or stored items unless explicitly stated.

9. Dispute Resolution

In case of disputes between Hosts and Renters, SpotWala will act as a mediator. All disputes shall be subject to the jurisdiction of courts in Bangalore, Karnataka, India. We encourage users to first attempt resolution through our support team before pursuing legal remedies.
